Since 2013 the extent of development which can be undertaken without the need for express planning permission has widened. Instead, it may be possible to carry out the work under ‘Permitted Development’ rights. In order to ensure that the existing or proposed use or development is lawful, you can apply for a Lawful Development Certificate (LDC). This certificate is a legal document that confirms whether or not the development proposed or which has been undertaken requires express planning permission or whether it falls under ‘Permitted Development’.
The types of permitted development
Residential permitted development enables house alterations. There are a number of works you can do to a property, even in the Green Belt, to extend your home. These can range from rear and side extensions to replacement windows and roof extensions. This proved very useful in helping one of our clients to achieve a rear extension to their property in London without having to apply for full planning permission.
Commercial permitted development mainly focuses on the change of use of the site. This can be applicable if the unit is in ‘A’, ‘B’ or ‘D’ use class. Depending on the nature of the site and its location, there are a number of alternative uses available to the site.
Agricultural permitted development widened in 2014 and now makes it possible to convert agricultural units into a number of uses provided that they were built and used for an agricultural use on 20th March 2013. The suitability of the site for the proposed use must be considered on a site by site basis. It is not always guaranteed that Permitted Development is applicable even if you meet the criteria above. Certain restrictions could mean planning permission is required for the development regardless.
